Figfy Terms of Service

1. Acceptance of These Terms
These Terms of Service ("Terms") are entered into by and between you and Figfy, Inc. ("Figfy," "we," "us," or "our"). They govern your access to and use of https://www.figfy.io, including any subdomains, content, features, functionality, and services ("Service"), whether as a guest or registered user.
By accessing or using our Service, clicking to accept or agree to these Terms, or executing an order form that references these Terms ("Order Form"), you agree to be bound by these Terms, the Privacy Policy at https://www.figfy.io/privacy, and any applicable Order Forms. If you do not agree, do not use our Service.
Our Service is intended for users who are 18 years or older. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
2. Changes to These Terms
We reserve the right to modify these Terms at any time. All changes are effective immediately when posted and apply to all subsequent access and use. Continued use of the Service constitutes acceptance of the revised Terms. Check this page regularly to stay informed.
3. Access and Account Security
You are responsible for:

- Ensuring all registration information is accurate and up-to-date

- We may disable your access if you violate these Terms or fail to meet payment obligations under an applicable Order Form.
4. Intellectual Property Rights
All content, software, and materials in the Service are owned by Figfy or our licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purpose.
You may not:
- Copy, distribute, or create derivative works
- Reverse engineer or decompile the platform
- Use Figfy trademarks without permission
5. Prohibited Uses
You agree not to:
- Use the Service for illegal or unauthorized purposes
- Interfere with or disrupt the Service or servers
- Circumvent security features
- Use automated systems to extract data
- Post content that is defamatory, infringing, or otherwise objectionable
- Compete with or build derivative platforms based on Figfy
6. User Submissions
By submitting content to the Service (e.g., reviews, suggestions), you grant Figfy a worldwide, royalty-free, perpetual license to use and share that content.
7. Third-Party Services
The Service may include integrations with or links to third-party services. We are not responsible for the content, terms, or privacy practices of those services.
8. Copyright Infringement
If you believe content on our Service infringes your copyright, please email us at privacy@figfy.io with full details. We may remove infringing content and terminate accounts of repeat infringers.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service’s availability, accuracy, or performance.
10. Limitation of Liability
To the fullest extent permitted by law, Figfy is not liable for any indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount paid by you to us in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify Figfy against any claims or liabilities resulting from your violation of these Terms or misuse of the Service.
12. Termination
We may suspend or terminate your access at any time. Termination does not relieve you of any payment obligations due.
13. Governing Law
These Terms are governed by Delaware law. Any dispute will be resolved through arbitration in Bethesda, Maryland, unless otherwise agreed.
14. Export Compliance
You agree to comply with all applicable export laws. You may not use the Service if you are subject to U.S. export restrictions.
15. Miscellaneous
These Terms, the Privacy Policy, and any applicable Order Form constitute the full agreement. If any part is unenforceable, the remainder will remain in effect.
